Driver drank alcohol before crash that left bicyclist dead in Gilbert, police say

Driver “veered off” into the bike lane and killed John Pomeroy; the driver was arrested several months later (see news story, below) based on toxicology results which showed an unstated amount of alcohol along with a prescription drug.  However since that time the Maricopa County Attorney’s Office has declined to bring charges for unknown  reasons…

… Court documents stated that on March 2, Adam Vesely, 37, was driving near Queen Creek and Higley roads when he veered off into the bicycle lane. Authorities said Vesely struck 66-year-old John Pomeroy while driving 44 miles per hour.
Pomeroy was thrown 84 feet into a nearby landscaping area. Bystanders and first responders attempted to save Pomeroy, but he died from his injuries at the scene.
After the crash, Vesely pulled over and stayed at the scene with investigators. Court paperwork stated he showed signs of impairment and admitted to drinking alcohol.
Vesely was taken into custody on Tuesday and booked on one count of reckless manslaughter.
Court papers said that lab testing confirmed Vesely was drinking while also using the prescription drug Citalopram, an antidepressant. Investigators said the drug has a warning not to drink alcohol while taking it, as it can increase sleepiness or affect alertness and concentration. The documents did not state his blood alcohol content (BAC) levels.
Vesely was taken into custody on Tuesday and booked into the Maricopa County jail on one count of reckless manslaughter, where he is being held on a $25,000 secured bond.

 

Criminal Case

As mentioned, although the driver was arrested on manslaughter, the Maricopa County Attorney’s office declined to bring any charges.

The Town of Gilbert brought a misdemeanor charge, the driver is set to be arraigned in municipal court 2/20/2025 on a misdemeanor charge (28-672 — presumably due to “failure to maintain proper lane”):
