This is one of those “it’s hard to know what do with some people”. She’s out there driving around on a suspended license, presumably for previous mis-deeds involving driving. (she has at least one prior dui)
These often make me wonder about sentencing, the prison sentence stems from the aggravated DUI. It would seem to me that 3 years of “probation” for the hit-and-run has no effect at all, because she’ll ostensibly be sitting in prison longer than that. Or isn’t that how it works?

Ex-state employee gets 6 years in hit-run

A former state employee who struck a 3-year-old Mesa boy in a hit-and-run collision in April was sentenced to six years in prison by a court commissioner.
Heather Mariah Grace Funk, 29, pleaded guilty to aggravated driving while under the influence of intoxicating liquor or drugs and leaving the scene of an injury accident.
The prison sentence stems from the aggravated driving charge. She was placed on probation for three years for leaving the scene of the accident, according to court records.
The boy was riding a tricycle on a sidewalk in the 3100 block of East Cicero Street when he was struck by a red Chevrolet pickup while crossing a driveway, police said. The boy survived. Police believed Funk was under the influence of methamphetamine at the time.
Funk was driving while her license was suspended and had a history of drug arrests. She had been hired by the state as a maintenance worker after her release from prison on another conviction for aggravated driving under the influence.
Ms. Funk is currently sitting in a New Mexico detention center for her alleged involvement in a fatal hit-and-run.

Warrants Issued for Occupants of Fatal Hit-and-Run Vehicle
Police are looking for a 40-year-old woman and a 34-year-old man who are believed to be the occupants of the vehicle that struck and killed a Las Cruces man Monday evening.
Heather Mariah Grace Funk, 40, and 34-year-old Earnest Thomas Fudge were believed to be in the 2010 Volkswagen Passat that struck two pedestrians Monday evening near the intersection of Espina Street and Arizona Avenue. Funk and Fudge both have warrants issued for their arrests.
About 8 p.m. Monday, Sept. 21, Las Cruces police and fire were dispatched to the report of two pedestrians who were struck by a vehicle that fled from the area of Espina and Arizona. Officers arrived to find the two victims. Valenciano, 43, was pronounced dead on scene. A 60-year-old man was in critical condition when he was rushed to an area hospital. The 60-year-old victim was later transported to University Medical Center of El Paso.
Traffic investigators believe both pedestrians were walking together and crossing Espina Street, heading west, when they were struck by the Volkswagen that was heading south on Espina. The VW fled from the area but was located by police later that evening. The car had significant damage consistent with it being involved in the hit-and-run.
Investigators obtained a search warrant on the VW and located documents inside the car that belong to Funk and Fudge.
Funk and Fudge are believed to be traveling together and may be staying in a Las Cruces area hotel or motel.
Anyone with information on the whereabouts of Heather Mariah Grace Funk or Earnest Thomas Fudge is asked to call 911 immediately.
I don’t understand how a person can just hit another person (or child) with a car and leave the the scene.. thank god this boy lived ! No family deserves to lose a love one in such a tragic way.. I just wish you would of learned your lesson heather cause then maybe you would of stopped and helped my dad after you ran him over , he might have had a chance to live but instead of doing the right thing and calling 911 you left him on the ground alone taking his last breaths … you took my dad away from us, we’re never able to talk to him or see him again and your out walking free in the streets .. I hope justice is served and they throw the book at you . Nothing will ever bring my dad Jaime Valenciano back but his life mattered and he deserves justice .
