Driver failed to yield in fatal crash with motorcyclist in Ahwatukee

I became curious about this because it happens to be very close to where I live, and I happened to notice the roadside memorial and wondered about all the carnage; it’s just off of Ray Road, right by the Melting Pot (Fry’s food strip mall); it was about three years ago now…

01/02/2018 Fatal collision; police say a driver of a vehicle turning left failed to yield to a going-straight motorcyclist, and now the motorcyclist is dead. In bicyclist crash jargon we would call this a left-cross crashtype; it’s particularly deadly for motorcyclists.

Drivers who make a bad-left are supposed to be charged with 28-672 “Causing death by moving violation”.

At the moment, I don’t know if the charge was brought; someone would have to get the crash report, find out the driver’s name and search court records. The City of Phoenix about a year or two ago made it much more difficult to get crash reports; it used to be quick (and free) to get crash forms by knowing the Phoenix file number,  1800010100. Alas, no more.

FARS is ST_CASE 40060 and does show a violation of “Other driver license violations”… which to me doesn’t sound like a “causing death…” but I don’t really know.

… Christian Nagel was cut off by an oncoming vehicle, police said in a statement Wednesday morning. Without yielding, the woman made a left turn in front of him into a private driveway, police said.

Phoenix police were called to the area of 3600 E. Ray Road at 5 p.m. Investigators said Nagel was thrown from the motorcycle and taken to a local hospital, where he later died. He had been wearing a helmet.

The 42-year-old woman driving the vehicle was not impaired, said Sgt. Alan Pfohl, Phoenix police spokesman. Speed did not appear to be a factor…
