Semi Rear-ends LimoBus on NJ Turnpike — killing one plus serious injuries
The truck that rear-ended comedian Tracy Morgan’s limo (June 2014) was speeding 20 mph over the limit, and its driver was approaching federal limits on how long he could be behind the wheel, according to investigators. The National Transportation Safety Board released a preliminary report Thursday on the New Jersey Turnpike crash that badly injured Morgan and killed one of his friends, comedian James McNair, in the early morning hours of June 7…
A criminal complaint filed by police said driver Kevin Roper had been awake for more than 24 hours at the time of the crash. Roper, 35, pleaded not guilty to charges that include vehicular homicide and assault by auto. He is free on $50,000 bond.
The NTSB report said the 2011 Peterbilt truck owned and operated by Walmart was speeding at 65 mph for the 60 seconds before the crash. Roper allegedly ignored a sign a mile earlier warning that lanes were closed ahead for construction and another sign a half-mile later reducing the speed limit from 55 mph to 45 mph, the report said.

It’s not at all uncommon in the aftermath of a bicyclist crash for observers to offer specious and unhelpful advice. Advice that would NEVER be uttered if the victims were motorists:
Was the Limobus that Morgan was riding in safe enough to be on the road? It only weighs about 6,000 pound — No contest between that and a loaded 80,000 pound semi. The Limobus people certainly had a right to be on that congested road, but should they have been? They were right, but now they’re dead right. I once saw a Limobus roll through a stop sign; those limobus drivers can be quite dangerous. And how about pickup trucks — they are quite flimsy. From the photo it appeared to be about ~4,000 pounds; that no contest when a 30,000 pound armored truck slams into you — the pickup truck driver should have known better. Pickup trucks shouldn’t be on the road, they’re too unsafe. In a crash between a full-sized pickup truck, and an armored truck, the armored truck always wins. It wasn’t mentioned in the news stories whether or not the people in the limobus or pickup truck were wearing crash helmets. And trying to punish those drivers at fault won’t bring anyone back from the dead, or make any of the victims heal; they’ve been punished enough already and have to live with the fact that they’ve inflicted grave danger on those foolish enough to ride around in those lightweight vehicles. Really, don’t the victims bear some of the responsibility? I see pickup truck drivers speeding all the time, they are very unsafe.
NJ Wal-Mart Tracey Morgan Case(s)
Meanwhile back to reality. Some updates in the NJ crash: legal maneuvering in December. So the criminal case against the truck driver is still apparently moving forward though it seems like no progress since he plead not guilty in June. Interestingly, the civil case against Wal-mart does not have the truck driver as a party to the suit. The criminal defense lawyer is seeking to put the civil suit on hold indefinitely until after the trucker’s case has reached an outcome. The lawyer for the truck driver accused of causing the New Jersey Turnpike crash that injured Tracy Morgan and killed one of his friends is accusing the comedian’s lawyer of interfering with his client’s right to a fair trial.
Attorney David Glassman, in court papers filed Wednesday in U.S. District Court, said Morgan’s attorney, Benedict Morelli, has made damaging comments to media outlets about driver Kevin Roper in an effort to exact a big-money settlement out of Wal-Mart, the owner of the truck in the June 7, 2014 crash….
Roper, 35, of Jonesboro, Ga. is not a defendant in the civil lawsuit that Morgan and two others have against Wal-Mart. He has pleaded not guilty to criminal charges of death by auto and assault by auto. Prosecutors claim in court papers that he had not slept for 24 hours before the crash.
